His cooperation agreement did not erase what he had done.
He pleaded guilty to charges arising from the financial fraud and his actions during Emily’s medical emergency.
His attorney argued that he had eventually called 911 and later cooperated substantially.
The prosecutor acknowledged both.
The judge would decide the consequences later.
Mother was offered a separate resolution.
Her attorneys believed it would reduce her exposure if she accepted responsibility for the drugging, the financial scheme, and her role in delaying Emily’s access to emergency care.
There was one condition she resisted more than any sentence recommendation.
The factual statement required her to admit Emily had asked for help and Margaret deliberately delayed it.
Mother refused.
“She was trying to destroy this family,” she told her attorney.
Even then.
Even after everything.
Emily remained the problem.
The prosecutor asked whether I wanted to submit a victim-impact statement.
I spent two nights writing one.
My first draft was angry.
I deleted it.
The second tried explaining my mother.
I deleted that too.
The final version was four pages.
I wrote about Emily.
How she laughed when she burned pancakes.
How she sent me ultrasound photographs with ridiculous captions.
How she kept the nursery camera because she feared she would be called paranoid.
How Ben would grow up knowing his mother through photographs and other people’s memories.
I did not ask the court for vengeance.
I asked that nobody describe Emily’s death as an accident caused by stubbornness.
She asked for medical help.
The people around her chose something else.
The morning before trial, Mother was given one final opportunity to accept the negotiated plea.
Her attorney spoke with her privately.
Twenty minutes later, he returned.
“She said no.”
