Chapter 13 - EMILY DIDN’T NEED TO BECOME PERFECT

The case did not require Emily to be flawless.

That was one of Rebecca's first promises, and eventually it proved true.

Emily had yelled at Dustin.

She had shoved him.

She had thrown the lamp.

She once sent him a message saying:

If you touch me again I'll destroy you.

Defense attorneys emphasized all of it.

Then prosecutors supplied context.

The full training footage.

Dustin's edited version.

His messages acknowledging the complete footage made him look worse.

Kayla's testimony.

Nate's group chat.

Hospital photographs.

The message telling Emily to say she fell.

Surveillance photographs outside my home.

Recorded calls.

The gym confrontation.

No single item proved everything.

Together they created a pattern stronger than any perfect victim could.

Ray entered a separate agreement involving destruction and concealment of records. He admitted deleting footage after Dustin told him Emily might go to police.

That damaged Dustin's defense substantially.

Dustin still refused a plea.

For a while.

Then forensic technicians recovered the portable hard drive.

Not from his car.

From a storage locker paid through the proposed new gym's business account.

It contained original copies of several deleted training sessions.

Including one video investigators had never known existed.

The night before Emily's hospital visit, Dustin recorded himself speaking directly to the camera after an argument.

Maybe he intended to post it.

Maybe he was rehearsing.

He said:

“She keeps threatening to leave because she thinks I'm going to beg.”

Then he smiled.

“She'll learn.”

Nothing after that showed the assault.

But the timestamp mattered.

So did intent.

Two days before trial, Dustin requested renewed plea negotiations.

Emily asked me what she should want.

I said:

“I don't know.”

She frowned.

“You always know what you think.”

“I know what I think. That's different.”

She considered that.

Then met with prosecutors herself.

No father beside her.

No instructor.
