Chapter 4 - THE PAPER TRAIL STARTED LYING BEFORE I ARRIVED
By Tuesday, I had three parallel tracks moving:
my mother’s medical stabilization,
immediate civil protection over her property and finances,
and preservation of evidence for the criminal investigation.
The bank gave us copies of the recent power of attorney, signature cards, and transfer authorizations.
The POA had been executed five weeks earlier.
The notary was a woman named Denise Fowler.
The document granted Julian sweeping control over finances, property, securities, and real-estate transactions.
Mom stared at the signature line.
“That looks like my name,” she said. “But I never signed that paper.”
That was when I started looking not only for fraud, but for sequence.
The false POA was followed within days by:
liquidation of the two investment accounts,
transfer of the cabin deed,
a new will leaving nearly everything to Julian,
and changes to a beneficiary designation on one annuity.
It was a package.
Someone had not merely taken advantage of one bad day.
Someone had built a legal toolkit for stripping an old woman as quickly as possible.
The bank’s fraud officer also confirmed that my mother repeatedly failed a verbal “owner verification” call during one investment liquidation because she sounded confused and medicated. The bank released the funds anyway because Julian, as attorney-in-fact, overrode concern and supplied supporting paperwork.
That supporting paperwork included a doctor’s letter claiming cognitive decline.
The letter came from Julian’s concierge physician.
The title records were worse.
The lake cabin had been sold six weeks earlier for $248,000.
It had appraised at $640,000 the year before for insurance purposes.
