Chapter 7 - The Three-Day Window
CPS records showed Elena’s mandatory report had been categorized for an expedited response.
The agency intended to make contact within seventy-two hours.
Paula received an automated voicemail requesting she contact the assigned investigator.
She listened to it twelve minutes after it was sent.
Then called Sergio.
Then called me.
The next afternoon she dropped Ruby at my house for three days.
That timeline was impossible to ignore.
“She knew CPS was coming,” I said.
Denise nodded.
“It appears she knew they wanted contact.”
“Was she trying to hide Ruby?”
“We need evidence before saying that.”
Investigators reviewed Paula’s purchases.
Fresh groceries.
New bedding.
Bedroom decorations.
Cleaning supplies.
Replacement door hardware.
All purchased within hours of the CPS voicemail.
Then there was a receipt from a self-storage facility.
One month.
Unit 57.
Paula initially said she rented it because they were decluttering.
CPS could not simply search it based on curiosity.
The police investigation developed its own probable cause after Elena’s photograph, Ruby’s disclosures, and evidence from the apartment.
A warrant followed.
Inside Unit 57:
the old stained mattress from Ruby’s room.
A dining chair matching the floor indentation.
Three cardboard boxes.
Expired pantry food.
Empty nutritional shake containers.
And a small indoor security camera.
Sergio said the camera monitored Ruby because she sleepwalked.
The memory card was missing.
Then detectives found the account associated with the device.
Cloud storage.
Partially deleted.
Not everything had been erased.
I was not allowed to watch the footage.
I didn’t want to.
Detectives summarized what was relevant.
Several clips showed Ruby alone in the bedroom for extended periods.
The chair was visibly positioned outside.
One clip captured Paula placing it there.
Another showed Sergio removing a dinner plate from the room after Ruby asked for food.
No physical assault appeared in the recovered material.
The evidence was still devastating.
Paula’s new story became:
Sergio invented the rules.
She followed them because she feared him.
Maybe that was partly true.
Then detectives recovered an audio clip.
Ruby crying.
Sergio saying:
“She already apologized.”
Then Paula’s voice:
“Not enough.”
I left the meeting and sat in my truck for almost an hour.
My sister had spent weeks blaming Sergio.
He deserved blame.
But every new piece of evidence pushed Paula closer to the center.
Then Denise told me something else.
Ms. Alvarez’s report had not been the first report concerning Ruby.
There had been another.
Eleven months earlier.
Closed as unsubstantiated.
Reporter confidential.
Different allegation.
Ruby being locked in her room.
