Chapter 6 - THE HOUSE DEAN COULD NOT BORROW AGAINST
The financial investigation widened.
Dean’s dealership opportunity was real.
So was the debt behind it.
He had already borrowed against his retirement account.
Taken a personal loan.
Used business credit cards.
And signed a preliminary agreement requiring him to contribute $150,000 within sixty days.
He did not have $150,000.
Rachel’s house was the solution.
Estimated equity:
Nearly $280,000.
But the property was her separate premarital asset.
Dean could not simply pledge it.
He needed Rachel to sign.
She refused.
Then she prepared to divorce him.
That made his timeline urgent.
The home-equity application expired Monday.
The fair was Saturday.
Rachel’s attorney, Olivia Grant, asked:
“What exactly did he expect an emergency custody order to do?”
It would not magically transfer Rachel’s house to Dean.
His legal theory was weak.
But practical leverage mattered.
If he could establish Rachel as unstable or negligent:
He could seek temporary custody.
Argue for possession of the marital residence for the children.
Increase settlement pressure.
Delay Rachel’s departure.
Make her fear losing the children if she refused financial concessions.
Not elegant law.
Coercive leverage.
Then bank records showed Dean had already told the prospective dealership partners:
PROPERTY FUNDING FINAL MONDAY.
He expected Rachel’s house money.
Somehow.
He also told his brother:
SHE’LL SIGN ONCE SHE REALIZES WHAT DIVORCE LOOKS LIKE.
Rachel had not seen that message before.
When Olivia showed her, she went quiet.
“He wasn't trying to convince me.”
“No.”
“He wanted me scared.”
“Yes.”
Then Emily’s school counselor produced another clue.
Two weeks before the fair, Dean asked whether the school documented late pickups and absences.
He specifically asked:
“Does that go into custody records?”
The counselor remembered because the question felt strange.
Dean had been collecting pieces.
Not evidence of actual neglect.
Potential raw material.
