Chapter 13 - The Plea He Could Not Outrun

Derek and Elaine both tried to avoid trial.

At first, they gambled that Brooke would back out and Kevin would soften. Neither happened.

Brooke’s statement came in strong and specific. Kevin held firm, especially after the state confirmed he would not face charges because he never completed the notarization and had cooperated promptly.

Then investigators pulled text messages between Derek and Elaine that eliminated any remaining fiction.

Need her emotional before papers.

Make sure she thinks this is about trust, not control.

If she fights, use the crazy angle.

The prosecutor offered Derek a plea deal on attempted coercion, felony forgery conspiracy, and unlawful restraint connected to locking the bedroom door and blocking my exit. Elaine received a separate offer tied to conspiracy, document fraud, and witness tampering after she contacted one of Kevin’s former clients trying to discredit him.

Both delayed.

Both hoped.

Then the judge ruled Brooke’s prior allegations could be partially admitted if the case went to trial because of the strikingly similar method.

That changed everything.

Derek pled guilty.

Elaine pled no contest.

He received a prison sentence that was not cinematic but was real: just under four years, followed by supervised release and permanent restitution obligations tied to the investigative costs and certain fraudulent document expenses.

Elaine got county jail time, probation, and a court order barring her from any future financial involvement in my estate or contact with me except through counsel.

When the pleas were entered, Derek looked smaller than I remembered.

Not humbled.

Reduced.

That mattered.

There is a difference.

Outside the courthouse, reporters were not waiting. There was no national scandal. No dramatic staircase moment.

Just me, Mara, and late afternoon sun on the steps.

“That’s it?” I asked.

“That’s the legal part,” she said.

“And the rest?”

She looked at me with that steady lawyer face I had come to trust.

“The rest is living somewhere they can’t reach.”
