Chapter 8 - THE PETITION THAT ENDED THE FAMILY PERFORMANCE

I signed the court petition on August 18.

It asked for a declaratory judgment confirming my sole trustee authority, invalidating any unauthorized development option, and permanently enjoining further attempts to encumber the Hale property without proper trust approval.

We also asked for preservation of Daniel and Vanessa’s business records.

Evelyn warned me what that meant.

“This becomes public enough that Lake Briar society will know something is wrong.”

“They watched my dinner go into a dog bowl.”

“I’m serious, Ruth.”

“So am I.”

The deeper cost was Daniel.

The petition named him.

Not as a criminal.

As a participant in unauthorized negotiations.

He came to the farmhouse after being served.

“You named me.”

“You signed documents.”

“I returned the money.”

“You still signed them.”

His face tightened.

“I’m trying to help now.”

“Then help while being accurately described.”

That hurt him.

I let it.

Protecting him from discomfort was part of how we arrived here.

The court entered a temporary injunction two days later.

Kessler’s option could not be exercised.

No lender could rely on the forged guarantee.

No trust succession could occur without judicial review while the alleged incapacity scheme was investigated.

Vanessa exploded.

She sent a twenty-page affidavit accusing me of hostility, memory lapses, and “irrational attachment to economically obsolete land.”

Then she included something she apparently believed would destroy me.

A photocopy of Thomas’s amendment without the missing final page.

Her lawyer argued that it clearly named Daniel successor trustee.

Evelyn read the filing and smiled.

Not happily.

Precisely.

“She just admitted possessing the mutilated copy.”

Vanessa had finally placed herself next to the missing page.

But she still insisted she had found the document that way.

Daniel called Evelyn that night.

Not me.

The next morning Evelyn said, “Your son is ready.”

“For what?”

“To tell us what he did.”

My stomach tightened.
