Chapter 7 - The Petition They Hadn’t Filed Yet
Rebecca found the draft in Daniel’s attorney correspondence after a subpoena was issued in the property dispute.
It was an unfinished petition seeking conservatorship over Maya.
Daniel was not proposed as conservator.
Lorraine was.
The argument was carefully framed: Maya’s mobility limitations supposedly made her dependent; her “emotional volatility” caused poor financial judgment; her resistance to selling the trust property demonstrated inability to act in her own long-term interest.
The facts were distorted.
But the purpose was obvious.
If Lorraine obtained financial authority over Maya, Daniel believed Lorraine could approve the sale on her behalf.
“Would that have worked?” Claire asked Rebecca.
“Not automatically. A court would require evidence, and the trust still creates issues. But it could have created leverage and delay.”
Maya sat across the table, pale with anger.
“They were going to tell a judge I’m stupid because I use crutches.”
Rebecca shook her head. “They were going to try.”
Another clue became important.
Maya had been pressured for months to let Lorraine join her bank account “for emergencies.”
Maya refused.
Then Daniel began telling relatives she was reckless with money.
Maya produced her statements.
Rent contributions paid on time.
Therapy.
Groceries.
Savings growing slowly every month.
No gambling.
No unexplained withdrawals.
The narrative of incompetence had been created because Daniel needed it.
Claire finally saw the full pattern.
First isolate Maya.
Then question her judgment.
Then push the house sale.
If she resisted, threaten conservatorship.
The assault happened when Maya still would not cooperate.
Claire gave every document to the investigator.
Maya made her own decision.
“I want to contest Mom’s authority over anything connected to my share of the trust.”
Rebecca nodded. “We can seek instructions from the probate court and ask for an independent trustee if necessary.”
Maya swallowed.
“Do it.”
It was the first deliberate step she had taken not merely to escape Daniel but to remove Lorraine’s ability to participate in controlling her.
The consequences began immediately.
Lorraine called Claire sobbing.
“She’s trying to take your father’s house away from me.”
Claire answered quietly.
“No. She’s trying to stop Daniel from taking it away from her.”
Lorraine hung up.
The following morning, Daniel was arrested.
Not because Claire was a colonel.
Not because a deputy suddenly believed everything.

Because the hospital photographs, Maya’s statement, the 911 recording, physical evidence from the kitchen, and Daniel’s contradictory interviews gave prosecutors enough to charge aggravated assault of a vulnerable adult.
And that meant his private family problem had become a public criminal case.
