Chapter 9 - Jack Had Changed the Trust Before He Died

The change happened two months before Jack’s heart attack.

I remembered signing amendments.

I did not remember every provision.

That was not dementia.

That was what happens when grieving people sign thirty pages after a lawyer says:

“This protects you.”

The house was owned through the Parker Family Residence Trust.

I remained trustee while capable.

I had full right to live there.

Sell it.

Keep it.

Spend the proceeds.

Move.

Do nothing.

David was a remainder beneficiary.

Meaning he might inherit what remained after my death.

Not before.

Then came the safeguard.

If I became incapacitated, David did not automatically control the house.

Arthur became successor trustee for the residence.

Not owner.

Trustee.

A fiduciary.

My power of attorney named David for many personal financial matters, but specifically excluded self-dealing involving trust property.

Jack built two separate systems.

Son handles ordinary affairs.

Independent friend protects the house.

I looked at Arthur.

“You knew?”

“Yes.”

“Why didn’t you tell me when David moved in?”

“Because there was nothing to tell.”

“Apparently there was.”

Arthur’s face tightened.

“I’m your friend, Lisa. Not your probation officer.”

Fair.

Then I read Jack’s letter.

It was shorter than I expected.

David is a good man when he isn’t scared.

I stopped.

Then:

When he is scared, he reaches for the nearest person who can solve it. Usually you.

My eyes filled.

I don’t want our house becoming the final rescue.

That was why Arthur’s presence on Sunday frightened Sarah.

She had read enough estate documents to discover his name.

If Arthur stood with me, then the path she imagined through incapacity and power of attorney became much harder.

But one piece remained unexplained.
